A Visit to Bay View Villas during CNY, 25-27 Jan 2009

BAYVIEWVILLAS VISIT REPORT 1

A very happy Chinese New Year to fellow members of the BVV community. In the last OWNERS’ CARE Meeting the committee has promised to look into various issues raised by the attendees as regards to the well-being of the BVV. For example, I remember Dr Ahmad reminding the committee’s responsibility to look after the full-paying members first as they were the ones who ‘suffer’ the most. I made a trip to BVV from the 25th of January till the 27th of January and these are my observations.

SECURITY
I arrived at about 12 pm on the 25th of January and the guard duly allowed me to enter by releasing the boom gate but he did not take down my particulars until I alerted him to do so. Subsequent cars were checked and their number plates were taken down in a log-book but again in the evening one side of the entrance was blocked and the other cars were allowed free passage. The security guard complained that the boom gate remote was not working and he had to release it manually and I was thinking it is a good thing, otherwise he would probably be dozing off.

LIFTS

On the same day, I parked my car at B-Block and saw around a hundred cars parked neatly around the 3 blocks. On that day, the lift at B-Block broke down twice. I saw large families waiting for the lifts to be repaired. The able-bodied ones walked up on their own but those who stayed on the upper floors and with kids decided to wait for the repairman. The repairman arrived 25 minutes after he was alerted and the work took another 15 minutes to the joy of those who planned to stay the entire day or two. Hats off to those who were patient enough to wait amidst murmurs of discontent. I spoke to some of my fellow sufferers and they told me the same thing occurs whenever there is a large volume of traffic (human that is) using the lifts and I would recommend stationing a full time repairman during peak periods .During peak periods, I also noticed many children playing with the lift buttons and their parents were nowhere nearby. This is a real hazard. Some youngsters were smoking and spilling ashes all over. I also noticed that the lift in block B had the button-panel exposed on the upper side and wires can be seen. This is dangerous as mischief makers can fiddle with it. Lifts at Blocks A and C were not affected on that day and seemed to work fine during the two days. However, I urge those staying on those blocks to report to the committee if they find the lift maintenance service dissatisfactory. Feedback is very important to us in the committee, so I urge the paying residents to get to know the committee members.

SWIMMING POOL

Upon arrival until the end of my two-day stay, the swimming pool was a sorry sight. The water was murky but the holiday-makers seemed not to mind it. The maintenance office told me that the JBA were doing some works the previous day and this resulted in the pool being in that state. The shower rooms and the toilets were not too bad. But the sauna room lights were switched on, the door was termite attacked and we need the management to seal off this room immediately as it is not only an ugly sight but can cause short-circuits.

CLEANLINESS

Throughout my stay, I saw the cleaners doing a good job, the corridors were reasonably clean. The tennis court was clean and the surrounding bay area and the car parks were also reasonably clean with rubbish neatly piled up for disposal. The barbeque pit area was however not as good as it should be. On my last day, the 27th of January, the lift lobby on the ground floor of Block B was not cleaned in the morning and the lift was also littered with cigarette butts. It took two calls to the management office to get the cleaners to do the job and it was finally done at about three in the afternoon.

MEETING WITH MR.SYEM

On the 26th of January, the treasurer, Mr.Maniam met up with me at 11.30am to discuss some issues with Mr.Syem

Why is our water-bill so high? Not identified the reasons but Syem suspects it could be the bulk meter and promised to meet up with the JBA officials to see if we can get some refund. A new bulk meter costs around 5000 ringgit. On my last day, I noticed that there was a leakage in the fire hydrant near the bay. I immediately called Syem and he said that it was some time that the hydrant was releasing some water. I urge other members to keep a lookout for any external leakages. In the meantime, Syem promised to call the BOMBA officials to repair the hydrant.
The handing of the accounts were discussed. The opening of the accounts is an urgent issue and all committee members are advised to contact the Chairman, Secretary or Mr. Syem for the next meeting .Mr Maniam expressed his reservations regarding the outstanding debts that will be inherited by the JMB.
At our last meeting, we had about 153 members who were on good standing, that is, promptly paying their maintenance fees and we hope more will do so, as we need the funds to make the necessary repairs and payments of essential bills. For instance, Mr Syem tells us that we owe the security company a few months of payments.
Mr. Syem says that all complaints on the comment forms distributed at the last owners’ care meeting were being looked into but he needs the assistance of the complainants to push for it and to meet him personally especially during weekends. Prior appointments are necessary. Complainants are also urged to pay up all outstanding fees as this is very important if the JMB is to function effectively
We enquired about the list of caretakers. Mr.Syem says that at present there are about 7 caretakers who take care of about 30 units at BVV. A meeting with the caretakers was suggested so that we could streamline their activities in an orderly manner. He suspects that some of them have not been paying their maintenance charges.


FINAL COMMENTS

My visit during this peak Chinese New Year period was actually a planned one to see what really happens during such busy periods. I urge fellow residents to make their observations and provide some feedback to me. This is important if we want to make BVV stand out as one of the preferred destinations at PD. I know, at the moment, things do not look so good but let us all put our heads together and do something instead of just waiting for things to happen. Believe me, it will only happen if you and us work together. Dr. Chong, Mr.Maniam, Ms.Patsy, and myself have been working very hard with hardly any resources and we are proud of the job. So please feel free to join us with your suggestions. Remind one another to visit our blogsite at least once a week.

Our Next JMB Meeting

Good News,
Some of you have been asking pertaining to the budget airport to be built at Negeri Sembilan, which may be a booster to our Bay View Villas development in the future. So here it is.
AirAsia, Sime Darby to build new Malaysian budget airport: Report
Malaysia has approved plans by budget carrier Air Asia and conglomerate Sime Darby to build a new low cost terminal within reach of the capital, according to media reports. The new terminal, to be called "KLIA East @ Labu", will be built on a 2,800 hectare site (6,919 acres) in the central state of Negri Sembilan under a private finance initiative, costing 1.6 billion ringgit (461 million dollars), the New Straits Times said. It will also anchor Sime Darby's developments in nearby Labu, which include five new townships that will offer education, health, sports, high technology, recreation and entertainment services, the paper reported. Transport Minister Ong Tee Keat was quoted in the Star daily on Sunday as saying that plans to expand an existing low-cost terminal were insufficient to handle the projected 30 million passengers by 2014. Ong said he could not give a timeline on when work would start on the project but industry sources told the paper a groundbreaking ceremony was being planned for late January with construction expected to be completed in two years. "We want to ensure passengers will be able to move from both places speedily, smoothly and efficiently," he added.

The paper said the new terminal would be slightly closer to downtown Kuala Lumpur than the present low-cost terminal and will boast more road and rail links. An AirAsia official told the Star that the carrier's fares could drop by as much as 15 percent when the new terminal opens. AirAsia has been lobbying the government to build a bigger low-cost carrier terminal to meet increasing passenger capacity which is expected to rise despite the present global economic downturn.

Quick Summary of December 14, 2008 Gathering @ BVV

Greetings,

Once again, thank you All who have taken time off to be with us at this meeting. The attendance could have been better if our Singaporean friends were able to come. Well we hope to get in touch with them soon. While awaiting for our next minutes of meeting to be sent off, here are the key issues discussed.

a) Elected committee members were reminded to avail themselves at all future JMB meetings whilst all owners are most welcomed to join in. Notice of meeting will be made known to all through this site, http://www.bayviewvillascommunity.blogspot.com/
b) Members were informed to study financial reports prepared by Hokawai and forward questions (if any) to JMB
c) Improving of present financial standing is key to the success in maintaining & upkeep of BVV
d) Members are advised to make prompt monthly maintenance payment effective Jan 2009
e) Target to improve present 153 'quality' payers to ~200
f) Hokawai to ensure 'payment history' checked before issuing reminders/calls or removal of utilities meters
g) Hokawai to revert with recommendation on setting up of an 'In-house BVV' management office
h) BVV house rules will be implemented soon
i) To publish a complete list of owners to faciliate contact / network / collection
j) Next gathering likely in March 2009 when financial statement ending 2008 is ready.

Inaugural Message from the Chairman of Bay View Villas Condominium Joint Management Body (JMB)

Greetings To All Owners,

To most of us, this has been a long awaited occasion for a JMB to be established. Well, it is finally here. The 1st Annual General Meeting of the Bay View Villas Condominium Joint Management Body (“JMB”) was convened on 10 May 2008 pursuant to the AKTA BANGUNAN DAN HARTA BERSAMA (maintenance & management) 2007 (AKTA663), sub-section 7(2) and was approved by the Commissioner of Buildings (COB) with the issuance of a certificate (Series No:005) dated 4 November 2008.

On behalf of the Joint Management Body (JMB), I take this opportunity to introduce to you the following office bearers (Joint Management Committee – “JMC”) whom we have put together in accordance to the provision stipulated in the same article as mentioned above at last election held on 10th May, 2008 at Port Dickson. As provided in the Act, JMC members are elected to perform the duties of the JMB. The JMC shall also consist of the Developer (in this case, the Liquidators) as a member.

To mention briefly, the duties of the JMB as set out in Section 8 of the Act includes the followings:-
(a) to properly maintain the common property and keep it in a state of good and serviceable repair;
(b) to determine and impose charges that are necessary for the repair and proper maintenance of the common property;
(c) to comply with any notices or orders given or made by local authorities or any competent public authority requiring the abatement of any nuisance on the common property, or ordering repairs or other work to be done in respect of the common property or other improvements to the property; and
(d) to ensure that the Building Maintenance Fund is audited and to provide audited financial statements to the purchasers.

The Act also provides the JMB with powers to collect from the purchasers the maintenance and management charges, and to recover from any purchasers any sums expended.

In brief, we had our first inaugural JMC meeting on 9 November 2008 at Port Dickson followed by our 2nd JMB meeting on November 21, 2008 at Hokawai’s Office, Kuala Lumpur. For more details, please refer attached minutes of meeting. Going forward, I am seeing this as a historic time for owners of Bay View Villas. For the first time, we are able to represent ourselves at this level so that our voices be heard and acted upon. Our unspeakable experiences with Cempaka Mewah Sdn Bhd – In Liquidation and the past Property Manager have not been forgotten but we believe that with much concerted effort from all of us as a community, this resort will be revived and be given a new lease of life.

On this note, I would also like to record my gratitude to KPMG (Liquidators) and Hokawai Sdn Bhd (Property Manager) for their supervision and safe-keeping to our properties since their participation in 2004, otherwise the condition could have been worse. Nevertheless, the JMC has affirmed to our Property Manager that much work has to been done, for example on GENERAL SECURITY to begin with. I would like to stress that in the interest of our family safety, and security from the intrusion of strangers trespassing into our compound, strict security measures and checks must be imposed at all times without compromise. A newly revised HOUSE RULES shall be implemented soon to further safe guard the common facilities from being vandalized, to contain ‘uninvited guests’ as well as unlawful activities within the premises. However we assure you that this will not burden owners who have engaged caretakers to maintain their respective units but nevertheless basic house rules must be adhered to.

To kickoff, I am delighted to inform you of our very first ‘OWNERS’ CARE MEETING CUM GATHERING to be held on 14 December 2008, Sunday 5.00pm, at Bay View Villas poolside.
You and your family members are cordially invited to meet up with fellow owners to further discuss and understand our future plan of actions inclusive of our many Singaporean friends. Refreshment will be served. Henceforth, I truly urge all owners to take time off to join us at this gathering so as to give your support and feedbacks in determining how you want this resort to be managed. I look forward welcoming professionals such as Lawyers, Accountants, Architects and others to be part of the team too. So if there’s going to be one overarching theme for this first inaugurated JMB, it's going to be to give all owners of Bay View Villas a reason for hope with aspiration in renewing and restoring our properties. So give yourself a chance simply because WE BELIEVE WE CAN MAKE A DIFFERENT in transforming this resort into a better and a livable place for all.
